1. Agreement to Terms
By accessing and using the services of Gliffbrook Singing Academy ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
2. Description of Services
Gliffbrook Singing Academy provides vocal training and music education services, including:
- Individual singing lessons
- Group vocal classes
- Performance preparation coaching
- Audition preparation
- Online educational content and resources
- Workshops and masterclasses
- Music theory instruction
3. Eligibility and Registration
3.1 Age Requirements
- Students under 18 must have parent or guardian consent
- Children under 13 require direct parental supervision and consent
- Adult students (18+) may register independently
3.2 Registration Information
You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy.
4. Payment Terms
4.1 Lesson Fees
- Payment is due prior to or at the time of service
- Prices are subject to change with 30 days' written notice
- All prices are in Australian Dollars (AUD)
- GST is included in all quoted prices where applicable
4.2 Payment Methods
We accept the following payment methods:
- Credit and debit cards
- Bank transfers
- Cash payments (in-person only)
- Payment plans (subject to approval)
4.3 Refund Policy
- Lesson packages: Refunds available for unused lessons with 48 hours' notice
- Individual lessons: 24-hour cancellation policy applies
- No refunds for lessons missed without proper notice
- Workshop fees: Refundable up to 7 days before the event
5. Scheduling and Cancellation
5.1 Lesson Scheduling
- Lessons are scheduled by mutual agreement between student and instructor
- Regular weekly slots are held for consistent students
- Schedule changes require 24 hours' notice when possible
5.2 Cancellation Policy
- Student Cancellations: 24-hour notice required for rescheduling
- Instructor Cancellations: Alternative lesson time offered or full refund
- Weather/Emergency: Lessons may be cancelled for safety reasons
- Illness Policy: Lessons cancelled due to contagious illness will be rescheduled
6. Student Responsibilities
6.1 Preparation and Attendance
- Arrive on time and prepared for lessons
- Bring required materials (music, notebook, etc.)
- Practice regularly between lessons
- Communicate with instructor about goals and challenges
6.2 Conduct and Behavior
- Treat instructors, staff, and other students with respect
- Follow studio rules and guidelines
- Maintain appropriate behavior during lessons and events
- Report any concerns or issues promptly
6.3 Health and Safety
- Inform instructors of any health conditions affecting vocal performance
- Do not attend lessons when experiencing contagious illness
- Follow all safety protocols and guidelines
- Report any injuries or incidents immediately
7. Instructor Rights and Responsibilities
7.1 Professional Standards
- Provide quality instruction appropriate to student level
- Maintain professional boundaries and ethical conduct
- Continue professional development and education
- Respect student privacy and confidentiality
7.2 Right to Refuse Service
We reserve the right to discontinue services for students who:
- Consistently violate studio policies
- Display inappropriate or disruptive behavior
- Fail to meet payment obligations
- Create unsafe or uncomfortable environments
8. Intellectual Property
8.1 Teaching Materials
- All teaching materials, exercises, and curriculum remain our property
- Students may use materials for personal practice and study
- Commercial use or redistribution is prohibited
- Recording of lessons requires explicit permission
8.2 Student Performances
- Students retain rights to their own musical performances
- We may request permission to use performances for promotional purposes
- Photography and video release forms required for marketing use
- Students may decline participation in promotional activities
9. Privacy and Confidentiality
9.1 Personal Information
- We protect student privacy in accordance with our Privacy Policy
- Personal information is used only for educational and administrative purposes
- Student progress and performance information remains confidential
- Third-party sharing requires explicit consent
9.2 Minor Students
- Parents/guardians have access to their child's educational information
- Mandatory reporting requirements for child safety concerns
- Age-appropriate privacy protections implemented
10. Liability and Risk
10.1 Limitation of Liability
To the maximum extent permitted by law, Gliffbrook Singing Academy shall not be liable for:
- Indirect, incidental, or consequential damages
- Lost profits or business opportunities
- Damages exceeding the amount paid for services
- Issues arising from student's failure to follow instruction
10.2 Assumption of Risk
Students acknowledge that vocal training involves physical activity and accept responsibility for:
- Following proper vocal technique and safety guidelines
- Recognizing and respecting personal physical limitations
- Seeking medical attention for vocal or health concerns
- Understanding that results may vary between individuals
11. Force Majeure
We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including:
- Natural disasters or severe weather
- Government restrictions or public health emergencies
- Equipment failures or technical difficulties
- Labor disputes or supply chain disruptions
12. Dispute Resolution
12.1 Communication First
We encourage open communication to resolve any concerns or disputes. Students should first contact their instructor or our administration team.
12.2 Formal Resolution
If informal resolution is unsuccessful:
- Formal complaints may be submitted in writing
- We will investigate and respond within 14 business days
- Mediation services may be recommended for complex disputes
- Legal action should be considered a last resort
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be communicated through:
- Updated posting on our website
- Email notification to active students
- Notice during lessons or communications
- Reasonable advance notice for material changes
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms constitute the entire agreement between you and Gliffbrook Singing Academy regarding the use of our services, superseding all prior agreements and understandings.
